Here goes:

Have a relative or friend who is getting deported from the US? Plan on being in the same position anytime soon? Well, here it is, for the first time, a fully documented and procedural guide to US detention and deportation. Please note that you will NOT find this information anywhere else. Half the practiced procedure during this process is NOT published anywhere under the US Code of Federal Regulations (CFR) or Immigration & Nationality Act (INA). That’s primarily because no one has taken interest in this procedure, and although there are manuals published by the House and Congress on the process of deportation and escorting illegal aliens out of the US, they are NOT followed by the monkeys at the Department of Homeland Security (DHS). The reason for that is that immigration law and procedure largely deals with people who are not US citizens, so the US government, house, or congress doesn’t give a flying fuck about them. Some of this is in violation of human rights, but who gives a fuck? If you’re not white and don’t hold a blue passport, you don’t deserve to be treated with dignity, do you? After all, America was formed after the murder of brown people wasn’t it? Anyway, think I’m getting off the topic here. Here’s how it works:

How it Begins

The person who homeland security wants to deport is picked up. Please keep in mind that the pick-up is made not by the USCIS or Immigration Services, but by Customs and Border Patrol, or, most likely, by Immigration and Customs Enforcement (ICE). The ICE is equivalent to the right testicle of the US Department of Homeland Security for enforcement of Immigration and related unlawful DHS policy and practice. They basically do the “dirty work” for the immigration fogies. So, if someone you know simply disappears off of the streets of America, or they go to see someone at the local immigration service center, or go for an Infopass appointment (http://infopass.uscis.gov/) and never turn up, guess what, they’ve been arrested. Please note that ICE is present at all Immigration Service Centers for this very reason: the arrest of those people they consider illegal. Whether they are OR not is neither their business nor that of the USCIS. A US court has to decide that, and good luck getting there. Not many people that chance; so America’s advertising about a free country is basically full of shit in this department.

So, how do you find out if someone has been picked up? Visit the local immigration office, and ask them where they hold immigration detainees. You’ll get a couple of printed pages from http://www.mapquest.com directions on them, which will be addresses of the “facilities” or jails that people are taken to when detained. Call them, ask for your party’s name, and you’ll know if they are there or not. Now, you can’t speak to the person who has been arrested. THEY need to call you; then you call back and set up a collect call system that costs you both your arms and a leg, and then the arrested person call you from inside the jail.

So now they’re in, and you’re contacting attorneys, and your friend is trying to extract information from the people who arrested him; what the hell is going on? Read on…

After the Arrest

Now is when the false assurances start. First of, ICE Officers will hardly ever talk to you or an Immigration Attorney. They think you’re the scum of the earth because you’re not white enough for them, and your attorney is equally pathetic because he/she is defending you. So, they will not give you any information. They may, however, give the arrested some false information about when he’ll be deported, but they will never actually tell you when, where, or how, because it’s supposed to be a ‘security risk.’ Yes, the small penis’ of the ICE Officers are at stake; they need to make the most of their petty 2 cents worth lives and they make everything sound like it’s top secret information that could change the course of the earth.

Typically, the ICE can hold a deportee for about 3 months before they’ll need special permission from other authorities to further hold the person, and because that special permission requires paperwork (which the dickheads are too fucking incompetent to do) and may establish that the ICE has ILLEGALLY or UNLAWFULLY arrested someone (this is very common), they will typically deport your arrested friend or relative within those 90 days.

If he/she has a committed a crime, the 90 day period will begin after they have done jail time for their crime. They will then be moved to a federal deportee detention facility. You can find a list of detention facilities and related information here:

http://www.ice.gov/pi/dro/facilities.htm.

If you believe an ICE Officer has arrested you by mistake, there’s really nothing you can about it. If you had a stay issued by a Court, you can file for a contempt of court. Also, you can file a Habeas Corpus with the court to request that the ICE officer be questioned and you be released. However, it seems like the system is rigged; ICE apparently feeds enough money to US Department of Justice (USDOJ) to where they don’t entertain such applications or cannot take action on them within 90 days, and that basically renders them useless. What you can do, however, is file a civil suit and get the media involved. That’s the only thing that scares the US government, and typically, this is more than an ICE Officer can handle, and somewhere somebody will always pay for fucking up. However, this is not something everyone can do as it may require some serious cash and persistence, and a lot of courage. After all, a lot of people unnecessarily tremble in the name of US Homeland Security.

The Deportation Process

This, in itself, is a big mess. There’s no set procedure or way. Typically, here’s the rule: If there’s a direct flight to your country of passport from anywhere in the US, you will be flown on either a US government plane or escorted on a commercial flight to the major international airport that such a flight will fly out of. From this airport, you will be put on a commercial flight ‘home.’ They will hand the passport over to the pilot or airline staff, and they will hand it over to you when you land or are on the plane, unless you’re from a really crooked country where these people are looking to make a quick buck off of you.

Now, according to the guide for escorting, information on which can be found on the USDOJ site at http://www.usdoj.gov/oig/reports/INS/e0105/index.htm, if no one if the deportee in question has not committed a crime, he/she does not need an escort. But somehow it turns out that homeland security has a very hard time complying with this manual or guide, and so, the rule is typically ignored.

Now, I’m not sure if this is how it’s done in other countries too, but I know this is how it works for the Middle East and Pakistan. Most likely, the deportee will be moved to the federal detention facility in Buffalo, NY, from where the ICE charters a plane belonging to any airline, and flies in a 24 hour plus flight to three or four countries, dropping the deportees off. The idea is to hand them over to local authorities, but most local authorities could give a fuck less about what the ICE wants them to do. In fact, there have been reports of ICE and Homeland Security Officers getting into trouble upon arrival in the Pakistan without having an invitation; something to be proud of.

The Return to the Passport Country

Once your deportee lands in Pakistan, he’ll be uncuffed and brought into the airport. The problem here is that the US flight is so secretive, that they don’t even inform the local authorities of the arrival of a deportee plane, with the result that the local authorities are not prepared. The only people who may have a clue about the flight is the air traffic control room staff, and they typically don’t communicate the information with the FIA (in Pakistan) or the FBI equivalent of the country the deportees are landing.

The result: deportees are hung up at the airport for a couple of hours for filling out a survey form after which they are let go. For Pakistan, the flight usually lands in Islamabad. For all other countries, it typically lands in the capital city. The last deportee flight that few from NY and ended in Pakistan flew on Tuesday, March 6, with a stop in Jordan, after which it carried to Islamabad, Pakistan.

Conclusion

What’s the worst part about this process?

- The inhumane treatment of deportees, some of whom may be highly educated officials who are simply put behind bars for making a solid, legitimate case against the USCIS or ICE but have the wrong skin color.

- The lack of information and pathetic secrecy issues.

- The hiding of ICE officers from lawyers and other genuine people for fucking up; talk about being American, don’t face your mistakes or stand up for what you do. Way to go Dick in Bush!

- The lack of implementation of legislature and the cowardice of judiciary in front of ICE.

- Thousands of human rights violations.

- The incompetence of American Citizens in realizing that there are such atrocities going on inside their own country, and

- The fact that no one is willing to do anything about it because the mistreated don’t hold American Passports.

What can we say? What goes around comes around. Stay away and don’t get involved. This is one of the several ways the US is shooting herself in her own foot, and what happens when you do that? You only need to be told if you have never stepped outside the US.

I was deported from the usa in ’99 to No. Ireland after 43 yrs.It was basicially
because of a cannibas charge i had in 1969..They told me it was a 10 yr ban.I traveled 15 times to Canada in meantime to meet up with family
but alas the US made the Canadians aware of my past conviction and they too banned me for 5 yrs last month…Now my family wants to me Costa Rica…I’m just wonderin if they could stop me from going there? Would you know? Thanks. Bill

  • http://www.asifism.com Commie B

@Bill, I don’t think Costa Rica shares immigration details with the Americans. I think Canada is pretty much subject to the will of the United States – I doubt if Costa Rica would be, but there’s only 1 way to find out. Why doesn’t your family come see your in N. Ireland?

  • joann

i wanted to know if my husband was deported he doesnt have a alice number or anything.he was arested in arizona trying to cross back to the us.he was not in jail but a half day and never had to face a juge or given papers. so i didnt know if he has been deported.

  • S.B

HEllo, thank you for this blog/website, its very helpful for me. Do you know if someone can go to the airport to give the detainee who is being deported, a bag with clothing, to say goodbye, if the person could be deported one of these weeks. I would like to know how to find out on which flight the person will be on. Please answer.

  • http://www.asifism.com Commie B

Joann – There is really no dependable way to find out. You can try and ask ICE or just look out for local news!

  • http://www.asifism.com Commie B

    @SB – short answer – no.

  • http://asifism.com kate f

i have a 3 month visitor visa which i only have 2 month’s left,i have tryed asking family for money to help me back to the uk and they cant help ….. im wondering when my visa run’s out what sort of trouble will i get into for being deported and what to expect when i arrive back in the uk? and is it a prisonable affence?

  • Richard S

I am a legal resident and I want to be deported, can I ask ICE to deport me?

  • Anonymous

@kate it is not an offence in the UK. In the US, they’ll probably take you into custody, get the paperwork processed and then deport you. If you don’t have money to fly back, deportation may be the only alternative. Of course, looking to a charity for help is another.

  • Anonymous

@Richard. ICE cannot deport a legal resident for no reason at all. You should just leave.

  • eddie

I  overstayed my B1/B2 Visa for almost 20 years. My original EU Passport s not valid anymore. I need to go back for medical reasons. (cost in the US way too high). Any suggestions?

  • http://www.asifism.com Commie B

I would just apply for a passport from your original country of
origin that issued your EU Passport. You’d still be a citizen of that country.

  • TJ

If someone was deported from the US. Are they legally able to fly into Puerto Rico’s Airport to catch a connecting flight to another country?

  • http://www.asifism.com Commie B

Puerto Rico is a US territory, so as long as you don’t have to go through immigration, you should be fine.

  • Samalyhow

I was wondering if someone has been deported is there a way you can sponcer them back ? Or can there kids sponcer them back?

  • http://www.asifism.com Commie B

After the period of no entry is over (and this used to be 10 years), I should think so. Before that, no.

  • mahana

i got married in USA  and i am a permanent green card holder. but now there runs some marital discord and my in laws are threatening me to make me deported. Is there any possibility that they can do so after making some case against me

  • http://www.asifism.com Commie B

@mahana, such threats are easier to make than they are to implement. How long have you been married? If it’s been several years then you genuinely got the greencard. The only way they can get you deported is either by saying that you committed a crime or by saying that you married only for a greencard – and if they allege the former, they have to prove their case. If they allege the latter, well, they are also part of the fraud and liable for hundreds of thousands in fines and a prison sentence. So, unless they’re evil geniuses, I wouldn’t worry too much about it. But if they are serious, you’d just need a lawyer to argue your side too, unless you’re confident you can do some reading up on the law and do it yourself, because good attorneys in the US are hard to come by.

I was deported in 2003 with a ban of 5 year to enter U S. I was on a B1/B2 10 years multiple entery visa. what is the possibility of getting a B1/B2 visa again, since my visa was also canceled.

    My Question:
I get deported two yrs a go, I am marrige, my husband is american citizen, what I have to do to go back to visit my mother in law? she is very sick, and she asked my husnabd when I can go to see her?, I just want to see her , my husnbad will be came brazillian citizen , but I want  go back to see her , not to live there , please help me !!

  • xoxo_85

Can they deport someone with LEGAL permanent card/green card??

My brother committed a felony but he have a green card. He’s been in prison for 1 year & now ICE picked him up. They said his release date is Aug 24. Does that mean that they’ll deport him on aug 24 or release him to us?

  • Beinghuman1969

How does one find out how long their deportation order lasts and/or if they are now allowed to enter the US again?

  • Cervantesgorge

my mom got arrested her case was deasemist and got deported we trying to find out when are they taking her back to her country if somebody has information or a phone were can i find out, tank you

  • http://www.asifism.com Commie B

Rute – I suggest waiting for 8 years. If you’ve been deported, you can’t even get a visa to enter for a visit. I’m afraid there’s nothing else you can really do.

  • http://www.asifism.com Commie B

xoxo, in practice, yes, they can. If he’s a greencard holder the ICE shouldn’t have picked him up unless he committed an immigration or customs related crime, or unless they wanted to deport him.

In this day and age, unless you are born on US soil as a US citizen, they can strip your greencard and send you packing.

  • http://www.asifism.com Commie B

There’s no length to a deportation order – just the restriction on re-entry as prescribed, I forget, either under the INA or CFR. Generally, it’s 10 years.

  • http://www.asifism.com Commie B

Try contacting the ICE field office where she got picked up.

  • J1

you know what i have a similar question as S.B. Can a family member escort the deportee on the day he/she are deported? Can you make phone calls from immigration prison to speak to your family?

  • j1

you know what i have a similar question as S.B. Can a family member
escort the deportee on the day he/she are deported? Can you make phone
calls from immigration prison to speak to your family?

  • http://www.asifism.com Commie B

J1 – No, you cannot escort the deportee – not to my knowledge, anyway. The person in custody can generally make outgoing calls via a Collect Service – so you the receiver have to pay for the call if you choose to accept it.

    THANK YOU Commie! :)

My son was beaten to a pulp by NYC White Pol;lice Officers in Queens all because he failed to appeared at his Army Commanders Office a couple times and he refused to show up for drills.  The police left him on the grounds of Mary imacculate Hospital where he was later saved by a passer by. While in a coma he was placed under arrest and handcuffed to his bed, he went from his hospital bed to Rikers Island and then to Maximum Security Prison up state, he served three years, he was beaten and raped by almost everyone. He was then taken to a Federal Detension at bufallo and three months later deported to the streets of Jamaica where he again went throo hell, to this day he is there still going through hell…Mind you, he is a US Army Veteran…

They arrested me and my whole family my father was a succesful business man there too, they hancuffed and shackled us all and lied and said they where taking us to a ” place where we will be held until they sort the documents out!!” they explained it was sort of like a house, as soon as they put us in there pathetic little van they called over on the radio to the county jail!!! i despise these gross people and they take advantage of the power they get and there repulsive pretty soon no one will want to visit the sates, why would you if your going to be interrogated for wanting to see family or friends over there!!…bastards i hope it all comes back around on them for being complete and utter jobsworths!!

I got arrested with domestic violence by slapping my boyfriend from our argument. They detained me in a police station for couple of hours then sent me t to the county jail.next morning my boyfriend dropped the charges. He never really file a a complaint on me  but the cop that took me did,now he spoke to the DA that Monday and dropped the charges since its my ever first arrest. I didn’t see the Judge or the DA on my court date because the dismissed the case. Now I thought I was getting released by unfortunately INS put a hold on me because I have a pending deportation case which is in court processing right now.I on the other hand already submitted my I-751 form since March and payed for the corresponding fee. Although I have a visa that was issued by the USIS until next year of June ICE still picked me up they detained me for a couple of hours in San Francisco, I asked my boyfriend to bring my passport that has a stamp from the USCIS, ICE did not honor the Visa that the USCIS issued me and they confiscated it.They even try to bargain with me right then and there for bail from $4000 to $3000 down to $2000 to $1500 always kept in asking me if I have money,my point is why do I have to pay to be free when I am legal to stay here because I have a VISA.I know that only Judge can put how much bail you really have to pay not police officer or a “supervisor” of a government agency. They said that they arrested me because of Section 287 and Section 236 I asked the one that was handling my case on what that those means before I signed it but none of any personnel knows what those section means, They said I just need to sign it so they can release me under condition to follow ISAP instructions and wear a stupid ankle bracelet for GPS so they can track me. They said they will released me from the program if I bail out or after my first hearing,That is not until next year of 2012 that is ridiculous.I need my passport because that is my proof that I can stay here and work but instead they made a copy of it and told me to just show an employer if I’m going to look for a job because they will see me on the system. then if that is the case then they tottally contradict them selves for putting me in this ISA program .Aurgh I’m so mad, I feel so violated! What should I do?

  • Eli

I got permanent residence 5 years ago through marriage. A year later I had a misdeameanor class B for shoplifting. I remarried to a US Citizen, and have two children. I want to become a US citizen too.
Will the misdeameanor affect me? or what are the changes I would get deported for that.

  • http://www.asifism.com Commie B

Get a lawyer – preferably one that looks and argues like a rottweiler. That’s what USCIS and ICE need to sort them out in cases like these.

  • http://www.asifism.com Commie B

There’s really only ONE sure way to find out if the misdemeanor will have an effect – to apply for citizenship. Given that the rules have changed of late and they can bring back your past to haunt you, I suggest consulting an attorney.

hey, i was born in russia, but when i was 10 years old my mother brought me to the united states. i went to highschool, college, got married-everything in usa. i’ve lived in usa for almost 20 years. than i was convicted of a crime (misdermeanor but it’s considered moral tirpitude(spell check) crime), and was deported 3 years ago. since than i’ve filed i-130 with the uscis. no response yet. my husband and the rest of my family are in us. i know nothing about russia. what should i do? should i even bother with a lawyer? is there hope? chance? that us will let me back in?

  • http://www.asifism.com Commie B

You may need an i-212 too as you have been deported previously. I would file an i-212 first – if they allow you to apply for a visa, then it may be worth consulting a lawyer. There is always hope – as long as you keep trying.

i-212 first, that is your PERMISSION to apply for readmission into the US. See http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=95cc2c1a6855d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

my boy friend has just finished a four year term in a US Federal Prison, he was born in Mexico 36 yrs ago but has lived in the US 34 yrs. He was released from Federal Prison last week, ICE has a detainer on him and he is being held in Okla at a detention facility until the paper work is completed. I am assuming he can be held in Okla up to 90 days? and then be escorted to Mexico?
My question is; How  many yrs does he have to stay out of the US before he is able to come back to visit his children, and family? And will he ever be able to come back to the US for work?
    Miss Pat

Hello, I applied for a passport about 2 years ago.  Up until now, I never questioned my citizenship and have always been treated as a US citizen. I was born through a midwife that is being investigated for fraud and have another birth certificate in Mexico.  Needless to say, they denied my application and were keeping my evidence…I am married to a US citizen and have never had any felonies (1 class B misdemeanor 10 years ago).  How probable do you think it would be for me to get deported?

Hi, my husband was arrested March 25th, 2011 for aggrevated assault, he was given a Misdeameanor class A and a year in the Harris County Jail which he gets 2 for 1 in the county jail. He is suppose to be released the 17th of September 2011 but he has an immigration hold. We have been married for 7 years and we have a 6 year old son and we had submitted a Petition to immigration and he was actually in the process when all this happen. I called an immigration attorney to be advised and he told me they need it to do a research on my husbands case and charge me a fee of $500 fee it’s been two weeks and I still don’t have an answer to what they’re doing. Could you please give me some advise to see if there’s anything else to be done for my husband. I am very concerned and don’t know what to do anymore.

i have applied for US non immigrant Visa and my visa was rejected and immigration officer told me that you can’t apply for 99 years now i want to go US what is the procedure? please help me.

  • anonymous

With no criminal charges, if someone has permanent residency but gets denied citizenship and gets deported how long before they can return to the US?

  • http://www.asifism.com Commie B

This is not particularly the best way to go about getting advice, Ruth, especially since in another post you mention how you were deported and ask for ways to get back to the US legally.

  • http://www.asifism.com Commie B

    Miss Pat,

That would depend on why he did 4 years in Federal prison. My guess would be he wouldn’t be allowed back for at least another 10 years – even then, he will have to apply for permission – and then it would be up to them the State Department to allow him a visit or entry for residence, and even after that, up to the ICE / USCIS to decide whether he gets to enter or stay.

  • http://www.asifism.com Commie B

If they can establish that you were not born in the US, that would effectively mean you have been present in the US illegally. I would ask for voluntary departure if they already have you on record and / or file for residence based your marriage.

  • http://www.asifism.com Commie B

He’s committed a crime, so they probably can deport him under the law. If you get a decent judge, I think the best option may be to try and convince him that he needs to stay here, even if he’s under parole or whatever else, for the sake of your son.

  • http://www.asifism.com Commie B

Did he get arrested for voting when he shouldn’t have?

  • http://www.asifism.com Commie B

I’d look for another country. Unless the immigration officer gave you in writing that you can’t apply for 99 years, he/she may just be making that up.

Nonetheless, there are other countries to consider in the world.

  • http://www.asifism.com Commie B

I think it depends on the deportation order, but I’m not sure. I’ve seen cases with 10 years generally, and read about some with 3.

  • Suzie_lovely200

no they ask him to send his history of voteing nd he hopeing they just deny the citizen ship

She filled an application when she first entered.  So is there any way she can find her information through us immigration?

No, I don’t think so. With a lie like that if she gets caught, she’s going to get into a lot of trouble. I suggest your uncle think of moving to where ever she is from.

  • Uenvymedontya

Hello everyone. My situation is that I was deported from the USA 51/2 yrs ago, with stipulations of 10yrs. I did 4yrs on a robbery case in 2002. I had never been arrsted before that, nor after. All of my children are Ameican citizens, My mom, Dad, and sister also. My sister is now batteling cancer in the States, my mom is 76yrs old, my life is there, and now also have been maried to an American Citizen. Can I start to apply before the rest of my time is up? Or does anyone know of anyone’s case ever being over turnned before the stipulated time? I also have a million letters from family and friends, as to why they need me back. I have been so depressed in this country, and havent been able to prosper which is also been documented. My children have also been targeted, and beaten up at times. They just want to go back to there homeland. Pleas help with ant advice. Thanks

  • Imacutiepie85

well, your situation sounds like it would fall under filing for a waiver against the 10 yr ban.  It’s going to cost you money and proving your hardships, which your documentation is a start.  Believe it or not, Immigration doesn’t consider your children as enough of a hardship, as crazy as that is.  All of the things you have described are hardships and would work toward getting u back here.  Contact a GOOD lawyer.  I am using one in California and she has a 98% approval rate in waiver cases.  Her website is http://www.humanrightsattorney.com
Good luck in your case and just do alot of praying to get back soon.

Need Advice- We are UK citizens and have been living in The U.S. for 14yrs- we are green card holders. My son is 20 yrs old he got arrested on a drugs charge in PA  and has a court date- as it is a first offence his lawyer expects it to be deferred . In August he and my husband were stopped re-entering the U.S at Newark airport after a trip to the UK – they have taken my sons passport and green card ( gave him a temp I-55I) he has to go to a deportation hearing unless he is found not guilty. I am very worried- is it likely he could be deported for a first offence – do you know what happens in the UK if you arrive as a deportee – do you get a record
     Thanks in advance

  • rebecca

Hi , my boyfriend is in a fed. facility in NM, he should be having his sentencing in Nov 3rd :( so i knw more than likely he will be thrown to Mexico any time after that court date. But I live in California, is there anyway we can request Immigr. or ICE to see if he could be escorted to this internat.border in TIjuana? instead of the one closest to that facility, which would be El Paso area, What do u guys Think ?! thank you :)

  • rebecca

try to seek an Attorney to help you guys clear out his drug  charges, i knw most local Public Defenders, free community lawyers, work with immigration lawyers, who assist them in making delicate  decisions when their clients have passports etc..

  • Pedro

im so sorry about your son thoes sons of bitches will pay. in the name of the son the father and the holy spirit.

  • Denkapetrov

I have been arrested and taken to the eloy detention center and most of what you wrote is correct i won my case of cancelation of deportation after three months but was there on an open case which now im having to plead guilty in the criminal court and im affraid there going to try to deport me for the same charge do you have any feedback for me?

  • Imigrant27

if i got deported 3 times, and i’m back in the country, would i get some jail time the forth time?

  • http://www.asifism.com Commie B

The only way to find out is for him to apply with you as his sponsor again. Because he’s already come back in twice after deportation, it is difficult, but may well be possible.

  • http://www.asifism.com Commie B

You’ll have to wait your 10 years – I’m afraid other effort will most likely result in lost lawyer and immigration fees. Like Imacutiepie85 says, they don’t care about your family, children or your hardships – sad but true.

  • http://www.asifism.com Commie B

Ruth, how can we help? Apply to go back.

  • http://www.asifism.com Commie B

If he is found guilty, yes, deportation will most likely be their next plan of action.

It’s the drug charge he needs to come clean on. If they let him off leniently and you then get a decent lawyer for the immigration hearing, they may let him off the hook.

As far as I am aware, the UK doesn’t really care about US immigration / deportation records – criminal is all that they really care about. He should be fine here.

  • http://www.asifism.com Commie B

Fat chance, Rebecca. ICE is not a request accepting organisation – they just do, blindly and stupidly and usually at the taxpayer’s expense.

You can always write to his immigration officer.

  • http://www.asifism.com Commie B

Yeah, leave while you can. Propose voluntary departure. Then you can try to apply and come back in the legal way (which may or may not be possible)

  • http://www.asifism.com Commie B

Well, it looks like you plan on finding out! Perhaps.

  • Teena Marie Dominguez

My significant other of 27 years, we have a grown daughter and two grandchildren, will be released in 16 months from a federal prison. He will have been there 14 years.  He took a plea on felony conspiracy, drug related.  He was born in Mexico and had  a legal residancy (green card) since a few months old, he is 53.  His parents and all siblings are us citizens, as well as myself and he has 3 children  and four grandchilren, all born in US.  He is the only foreign born.  He has an ICE hold and has NOONE in Mexico.  We are about to hire an immigration attorney to fight the deportation.   Are we wasting our money?

  • Melhernandez27

Ok, I need help…I have a friend who was deported (10/05/2011 ) for not having a license/being here illegally etc., He didn’t commit a crime (in the sense of murder, stealing….) He is now in his home country, Honduras, but i remember he told me that they told him, that he could apply for a petition to come back…he said that takes about 4-9 months. Now, i searched online to see how long it takes for deportees to be able to return to the US and i found one answer that said, if you’d been here for 12 months or less, you can come back in 3 yrs. If you’d been here 12 months or more, you have to wait 10 yrs to come back….i’m confused. I want him to be back NOW actually and so does his family…what can I/we do to help him come back sooner? PLEASE contact me at melhernandez27@hotmail .com   thank you!

  • Melhernandez27

OR comment here i guess….i just need answers!

  • http://www.asifism.com Commie B

Do you have any of the paperwork he may have had when he got deported. That will tell you. The option is just to allow for permission to enter. If they approve that, he can then apply for a visa.

  • http://www.asifism.com Commie B

You’ve overstayed. I would ask for voluntary departure, leave peacefully and then get your wife to sponsor you to come back.

  • http://www.asifism.com Commie B

If you want to go back permanently, just go. Do you have an Iraqi Passsport?

  • http://www.asifism.com Commie B

I would think that you are, with a criminal record that got him 14 years. But then, miracles based on hope do happen.

  • http://www.asifism.com Commie B

I don’t know if he will get out. He may have to go bak out and then come back in. If he gets the option for voluntary departure, he should take it. Once you’ve made a mistake in the American system, the only way you can get past that is if you find a half decent, sympathetic immigration officer and judge. These are far and few.

  • http://www.asifism.com Commie B

    Yes.

hi berenice my boyfriend got locked up for disorderly conduct on Sep 9. He also has an immigration hold on him. he was given a bond for the misdemenor but not for immigration. I have talked to several lawyers and the immigration department. There is a very very slim chance that immigration will drop a hold on him. i hope they will but honestly i dont think so. what will probably happen is that he will either be deported back to his country or they will give him voluntary deportation which in that case he may be given a bond and withing about 60 days he has to go back to his country. if he doesnt go than if he gets caught it will be worse for him. if he does you can do a fiance petition application that you get from immigration. i dont know how long the bar is for them to come back to the country i have heard different things. Call the immigration officer in the jail he is in or the jail he will be transported to. dont give his name. call different agencys that help people who do not have permission to be here. i know its hard but i hope all works out for you.

The thoughts I get about all of this that run through my head are not good, and it’s not me.This whole thing has made me so bitter, and very angry at my own government!!

My husband was a LPR and has been here since he was 8, in 1989.  He got a charge of possesion of a firearm by a felon in Nov.’09.  In June 2011, we had an arguement, cops got called, and her arrested.  ICE came and got him after his case was completed (time served 1 month) and now, 4 months later, he has optioned for voluntary deportation.  When he goes back to Hondarus how can I get him back?  I am an American citizen, we have been married 4 years, and we have a biological child together as well as my child he has raised since she was 1.  I love him dearly and need some help.  What about post-conviction relief?  The gun wasn’t his, and in VA we only have until nov. 2011.   Any ideas on how to get my husband back is greatly appreciated.

Question? How does ICE usually get involved in an Immigration case? They came knocking on our door a week, and a half before my wife, and I would have had our first greencard interview at USCIS. They came to arrest her,and remove her. They said she had unlawful presence here, and in the same they were trying to prove our marriage as being a fraud but,it’s not a fraud. The deportation officer called me on my phone, and wanted me to come down, and withdraw my petition, and give him her passport, and was saying that they were watching us for a few months, and they didn’t see me at the house, and all of this crap. How did they get involved I wonder? Does that sound like it was done from someone who knows us,or do you think USCIS tipped them about her presence here?

it is Super obvious somebody totally snitched or tipped them on your family, how sad :/ ..you will more than likely need a good immigration attorney..

  • James

Yeah I figured that.I know exactly who is was too.A very jealous former boss of mine. He didn’t like that my wife was out making great money as a Realtor, and had a better car than him.I was his “lowly employee”that’s the way he thought anyway. Karma is a bitch though!! That was 2 years ago. They sent her back to Romania on a voluntary departure after 5 months of her being detained.I went to visit her every week while they had her in there. We’ve already gone through 4 attorneys, and they all just take money, and no results.ICE just does whatever they want.I’ve been over to visit her in Romania a couple of times now.I talk to her everyday on the phone. She is now getting very discouraged about everything.I don’t want her to give up though because I’m not!! my I-130 is approved as of last year but,we just got denied this year on the I-601 adjudicated in Vienna Austria USCIS because our lawyer didn’t present my extreme hardship correctly. This is such a difficult thing. I thought America was a free country. Not anymore apparently!! When the next Revolution starts,I will be fighting against the government. They screwed our lives up badly!!

  • missy

Oh man that is terrible to hear :( , i can’t believe u didnt have success w/ attorneys either, darn, But don’t give up, ive worked in the legal field as a secretary for many years, and all ive learned to know is that THere Are Loop Holes for everything, You have to be Persistent, i know it’s hard to say, but when that is the only choice, you have to keep trying,,that is how i feel w/ my spouse too, I think we are just gonna apply to be Canadians, i mean really, we are too,, dissapointed :/

What do u guys think I whent  Ice to drop off stuff for my husband cuz he was going to be deported and the officer ask me 1st if I was a us citizen

  • http://www.asifism.com Commie B

As he is taking voluntary departure, technically, yes.

  • http://www.asifism.com Commie B

I think this is a domestic issue to start with. Do you still want to be married to this kind of a husband?

  • http://www.asifism.com Commie B

I’m afraid there is not much you can do under the law, because this law isn’t particularly humane. At what stage are you in your application? Have the lawyers ever spoken in front of the judge (most lose their tongue)? Your only hope is to explain to him that your husband hasn’t done anything wrong, from start to finish and that deporting him would create problems for the great USA (lose the cynicism when you speak to him/her, though).

  • http://www.asifism.com Commie B

If you haven’t entered, theoretically you shouldn’t be allowed to enter and should  be sent back on the next flight. But incase they decide to hold you, is it really worth travelling if your fiance is such a moron to start with?

  • http://www.asifism.com Commie B

    Yes.

  • http://www.asifism.com Commie B

Yes, given the ICE’s current behaviour, it would appear so.

  • http://www.asifism.com Commie B

Call the ICE or Police Department.

  • http://www.asifism.com Commie B

Sorry to hear about this, James. The ICE does watch over some applicants even if they are not tipped by anyone. At the end of the day, they have to meet their quotas, and whilst they may never publish this, I think the quotas have to do with a mix of ethnic backgrounds from each state, etc.

If you have evidence that your former boss did lie and tip ICE off, sue both him and the ICE for damages. If you win a civil suit against them, all other decisions can also be overturned.

Wait another 6 years before doing anything, really, or it will most likely result in wasted money. Sorry.

  • http://www.asifism.com Commie B

    Why was he arrested?

  • http://www.asifism.com Commie B

So there is a warrant outstanding for you for not appearing in court? Stay the hell away, or post bail before you land in the US against those warrants. When you get there, show up to court, and do not get convicted.

  • http://www.asifism.com Commie B

Yes he can. Why doesn’t he come back to Scotland?

  • http://www.asifism.com Commie B

Yeah if you keep it up!

  • http://www.asifism.com Commie B

If he has opted for voluntary departure, he can reapply from honduras. If he was convicted of felony, it may be hard to get a visa, but the voluntary departure will certainly help.

  • http://www.asifism.com Commie B

How long had be been present in the US illegally?

  • http://www.asifism.com Commie B

    Yes

  • http://www.asifism.com Commie B

Class one – he will most likely be deported.

  • http://www.asifism.com Commie B

They might actually put him in jail first for what he’s done before they deport him.

  • http://www.asifism.com Commie B

Why was he deported. It all depends on the reason and what his papers said. You may not be able to apply untill 2015.

  • http://www.asifism.com Commie B

Sorry to hear this, James. I think you’ve posted elsewhere here too. I can only advise that you not do anything silly. Consider moving – there is more to the world than America can offer, although the US government comes to claim whatever it needs more often than not, no matter where it is!

My bother was deported last year, he came illegal, and I’d to know if once I become a citizen could I apply for him so he can come llegaly in the future. Thanks

my granddad is very sick he have cancer no one is there to help him how can i get a visa to visit him

  • Guest

I’ve got a question…I have a brother that was a green card holder for the USA.  He committed many minor crimes when he was under 18 because of drug use.  He was still on probation in his adult years.  He got an opportunity for a job in Jamaica where he’s a citizen and decided to move back, but did not inform his probation officer.  This all took place in 1998.  He gets a call from the police station after putting in a gun permit for his job like he has for the last 10 years or so.  The station calls him to report in the morning or he’ll be arrested.  Could it be his past is coming back to haunt him?  Can they extradite him to the USA after all this time ?  or will he serve time there?

if someone is deported in Miami dade county and sent to ICE broward facility is there any public records i can see if the person had any charges when they got arrested? i tried looking at the miami dade sherriff office booking blotter already but i didnt find anything.. ?

    Hi All,

I have a question. If someone being deported out of US and he/she owe a lot of money to credit cards, loans….ect. Do the US government forfeit his/her checking / saving account to pay for the banks, loans before he or she deported? Thanks.

  • http://pulse.yahoo.com/_H5KV66QY5R7SVR4QNAPUSVQFKE Friendly

I think they bar your parents for 10 years from entering the US. You may have to wait…or may appeal so you can sponsor them to come here earlier.

  • http://www.asifism.com Commie B

Do we need  to think anything, in particular?

  • http://www.asifism.com Commie B

Perhaps. What was he deported for?

  • http://www.asifism.com Commie B

The drug charge may become a problem, but really, I’d say anywhere outside of North America is fair game.

Getting deported from America is really not a problem, I should think. All of Europe knows US immigration is, well, uncouth.

  • http://www.asifism.com Commie B

Just call the police if they are doing something illegal.

  • http://www.asifism.com Commie B

    Apply for a visit visa

  • http://www.asifism.com Commie B

I doubt it. He was a minor when it happened and as long as he’s not to keen on going back to the US, he should be OK.

I don’t know how corrupt or screwed up Jamaica is, but if there’s money in it, they may want to force extradition.

Why doesn’t he inform his probation officer now?! He’s left for good, no?

  • http://www.asifism.com Commie B

There is no public record for ICE arrests as far as I know. If he is taken to court and charged for a crime, then it may become a matter of public record. Otherwise, immigration that doesn’t deal with US citizens (and of course, it doesn’t) generally doesn’t become public record – much of it would be shameful for American authorities.

  • http://www.asifism.com Commie B

They can, but I’ve never heard about or seen this happen. I would suggest moving the money out, though, because if they choose to freeze your accounts, you are flat out of luck!

Hi i got refused entry because the last time i was there i worked for a week,, does the refuel  mean i am on a 10 ban ??? how do i find this out ???

  • Christy

Hi… I have a few questions if anyone has answers they would be greatly appreciated!
I entered the USA in 2002 under my parents e2 visa. This expired October 2010 i then went back to my home country with my family (UK) and after staying for a short time decided to re enter the USA under the ‘visa waiver’ and try and make it my permanent home , i married a US citizen in Oct 2009 (never filed for my paperwork) and since re entering PHX,AZ from Heathrow in November 2010 under the visa waiver program i was eligible to stay for 3 months..as i am married to my american husband i planned to file my paperwork in order to stay permanently in the USA. long story short , i overstayed the VWP , i was detained at a detention center for 6 weeks in AZ and then ‘ removed ‘ under the visa waiver. I paid $3000 to a lawyer who guarenteed me a bond and that was not the case, i just got ripped off and false promises:( after my 6 week detention I was finally put on a flight back to the UK last week and was told i am being ‘removed under the visa waiver’ and now im wondering if i have a ban from coming to the USA?  I understand i can not use the VWP to come back to the USA ever again, but can i apply for a visa whilst in the UK and come back to the states in one year or so after applying? When i left the detention center i was told i will not have a ban from coming back to live in the Usa, and told by the consulate i may have one…does anyone know? i overstayed for over 3 months but less than a year :) … Thank you all! xOxO Christy

After serving in the Angola war 1984-1987 I decided to travel to the USA. I got married in the USA after only 3 months. I knew all along I am gay. I payed the 10K my so called wife charged me. After all was done I moved to Texas where I met the love of my life. The 10K wife wanted more, the love of my life RICH and paid. This carried on for many years, finally I refused to pay more and she reported me as a fake husband. I got deported, took a flight from DFW airport to Mexico City, returned the next day. The border control between TX and Mexico in day was a piece of cake. As all couples who have been together for many many years we also had our problems. Our personal problems got out of hand and I took a BA flight to South Africa the next day. One week later he arrived and we decided we can´t live without each other. Mexico was a problem so I applied foe a Canadian visa, this was issued without a problem at a HIGH PRICE. The next day I left for Canada on BA flight, price tag 5K in US funds. Lew was there waiting for me. Lew is a MD so is Larry his best friend, they drove to Canada from Texas, spent a few days in our summer home in West Yellowstone MT and then on to Canada. I have crossed the Canadian border so many times during my 20 years in the USA, sometimes just for high tea at the Prince of Wales hotel. This was nolt the correct day border control was stiff, I did not sound like a Texan and they ordered us to park the car. To make a long story short Lew was treared like shit by his own country men, at the time 74. I was deported again. Lew was fined 10K plus 25K attorney. I am now living in Brazil as I really don´t care for South Africa. Lew is ill but visits me as often as possible. All we want is to be together. Brazil is not an option as Lew is ill and needs his US based doctors. Thank you for reading all. All advice much appreciated

My name is Melinda Colella, I am an american citizen.  I am writing this letter on behave of my husband Carlo Colella, who is an italian citizen.
On September 25, 2007 Carlo arrived in the United States on a visa waiver.  He had a childhood friend who lived in Charleston, South Carolina, that he                                                     was there to visit.  On October 12, 2007 I met Carlo in a pizza shop in downtown Charleston.  From that point we started dating.
On November 26, 2007 Carlo hired an immigration lawyer Mr. Marko Torres of Charleston to file for an visa extention for Carlo to stay in America and to handle any immigration matters.
Febuary 25, 2008 Carlo and myself married in Pennsylvania, with my family by our side.  We had our honeymoon there and spent time with my family.  When we returned to Charleston, SC we contacted Mr. Torres to let him know about our marriage.  At that time Mr. Torres told us that all my husband had to do was change his status because we were married now.  He said Carlo was legal to stay in America but he could not work.
On January, 2009 a friend of Carlo’s from Italy who was a special agent for the N.C.i.S introduced Carlo to Special Agent Frank Bruzzi.  Carlo and Mr. Bruzzi talked and Carlo informed Bruzzi that he could find some valueable information for the him.  Carlo told Mr. Bruzzi that he would work with him as long as Mr. Bruzzi got Carlo citizenship for America and Mr. Bruzzi agreed on the terms.
Carlo informed Mr. Bruzzi of several crimes including explosions, firearms, drugs, fake I.D.’s and fake greencards.  All of the people involved in these cases were jailed.
On July 13, 2009 Mr. Bruzzi called Carlo and said he wanted to meet with Carlo to talk, Carlo agreed.  When Carlo arrived to the office Mr. Bruzzi and I.C.E agents told Carlo he was under arrest for overstay his visa and they told him to Charleston County Detention Center.  After one week they moved him to Stuart Detention Center in Giorgia.  On August 21, 2009 they send Carlo back to Italy.
During all this time I was in contact with Mr. Bruzzi and he assured me that he would make sure that Carlo would return to America.  On Febuary 5, 2010 Mr. Bruzzi called me and told me that he got Carlo a parolee visa for Carlo to return to America for 90 days to testify in the cases he worked with Bruzzi.  He said all we had to do was go to the Italian Consult to get the proper paperwork for his visa and to leave for America.  There was no paperwork for Carlo at the Consultant.  I contacted everyone from Immigration, I.C.E, homeland security, visa centers, embassay, and the American Consultant and no one knew anything about this situation or had anything on file for him.  The visa expired on March 5, 2010.  After the trials were over Mr. Bruzzi informed us that there was nothing he could do anymore to help us and that all of the suspects pledied guily so they didn’t need him anymore.
We feel like Bruzzi used Carlo and abused us.  Now we are in Italy stuck and no answer.  So our question is how do we fix this problem and is there anything we can do about how Carlo was treated by the N.C.I.S and Mr. Bruzzi?  He ruined our lives.  We have our houses, car, family and everything we own in America and we need to go home!!! PLEASE HELP US!!!  Thank you for your time and god bless.

We are still waiting for your response to our problem, ask everything and go home, thank you in advance.one of five cases performed by my husband Carlo Colella was to Chester Eugene Pilcher, man who sold the five bombs in January 2009, but NCIS agents had promised my husband a green card to stay in America forever, but then arrested him and sent back to Italy because he had the visa expired, but after all we do not know how to return home in Mt. Pleasant, the officer Frank Bruzzi used to my husband and now all we want and go home.

I need some answers please! My fiancee recently got detained and is currently under custody because he was caught driving without a license(expired). Well, he was granted a voluntary departure at the beginning of this year that he over extended for less than one year. My question here is is he automatically bar for 3, 5 or 10 years. I’m aware than an overstayed granted by an IJ by more than a day bars the imigrant automatically for 10 years, but been that he is currently under custody his voluntary departure turns in to a order of removal? Do the rules of re admission, change of status, waivers will be different now that he has an order of removal?

And since now turns in to an order of removal, can he appeal the order through me(adjustment of status)?

Also, would me marrying him help him.. we were getting married on 01/27/2012 anyway. What about if he is deported, and I marry him on his country and as a US citizen I try to bring him back….

    Please advice!

i am sure that u would agree with me that we(USA) r a land of opportunities and welcome immigrants,we have given more visas to the entire world that all the contries of the world combined.one of the things that attract flolks to our “crazy” country is simply because we r a nation of laws.so u r welcomed in put quicked out should u break the law.i would recomend that u stop your criminal activities and hire an attorney.crime pays, jail and deportation…do the math Kevin is it worth the efforts?

  • Asindler84

Miss,we r a country of laws…and i am sure that is ultimately one of the attributes of our great country u like,u will always b welcomed in but kicked out whenever u break our laws.i would speak clearly and openly to an attorney for counsel.please take care of your drug issues.your life is definately worth more than that.u r special, please take note of that

  • Asindler84

depends on many variables.i would consult USCIS.gov for further details on that.

  • Asindler84

not even a psychic would corectly answer that.”police” do not check for anyone immigration status,ICE(Immigration and Customs Enforcements) does that and anything thing can land u in their radar.and i mean anything.so weigh your options carefully.good luck and please stay out of trouble, dont break our laws,or u will surely b on the next flight to your provenance

  • Asindler84

a good and “honest” lawyer would give u an answer to that.

When i left the detention center i was told i will not have a ban from coming back to live in the Usa, and told by the consulate i may have one…does anyone know? i overstayed for over 3 months but less than a year :)

  • Dominic

WONDEFUL POST THANK YOU , PLZZ help if anyone knows any answers.. I was on the visa waiver and over stayed but i had a friend who was also on the VWP , he left the country on time before his 90 days,(i continued to stay in the US) but whilst leaving the USA he dropped my i94 off along with his at the airport…. Will that show that i left on time??? Anyone know ? Thank you!!

  • Kevin Boubouleix

Obviously the worst reply ever, thanks, I’ll think about my actions before I get “quicked” out.

  • Dancewithursoul

if a person is deported with ten years of punishment can they come back with a Visa??

  • Miss AZ

i am so sorry to tell you this but i believe ( as i was in a detention center ) volunteer depature can take 1 month 3 months max! as she has gone with the root of Volunteer /DEP as early on as two weeks, i believe she will be able to leave within 30 days. Is she in a dentenion center?

  • Miss AZ

Thankyou very much for your help and advice.

  • Miss AZ

PLZ help i got removed under the visa waiver removal as i over stayed my VWP by 3 months 3 days i am told i will not have a ban from re entering, but as i have a pending drug charge and it will show that i have over stayed my visa do u think if i apply for a k1 fiance visa i will have any chance of getting accepted for the K1 fiance visa as it is a real marriage…any help/advice is appreciated. thankyou.

  • Picnan619

My setpmom is being deported.  She is a terrible person and my dad actually has custody of my minor brothers and sisters, she is stating that she can’t be deported because her children need her.  This is so not true.  All she does is upset them every 6 months when she is not so high that she has forgotten them and then she leaves on a round of promises to call and its left to us to pick up the pieces again.  How can I tell the judge it isn’t true without her finding out it was me?

  • clare

    hi
its not just ‘people with the wrongh skin colour” who get detained & deported my white british brother is in a detention centre at the moment!

  • Donnie Pullis

I currently have 2 friends in a Colorado County Detention Facility on a Immigration Hold after picking up a couple charges. I have been through this before with another friend a few times. Every time he had a Immigration Hold on him. I posted his bond on 6 different occasions, he was only picked up and held by immigration one time out of the six. Have the laws changed recently? Do they pick up everyone with a hold now? I would like to bond them out so they don’t have to sit through the court process. I would appreciate any info and help I can get. I am also looking for a good Immigration lawyer in the Denver area. Thanks D

Will a person who is currently living in the US but illegal, be stopped if he tries to leave the country (with his own passport) to fly to the UK?

  • gabriela

    hi everybody ,
i have some problems and maybe is somebody who can answer me to the question
    i have tourist visa B2 with M entriens and from December 2009 I traveled so: Dec 3, 2009-21 decemrie 2009 (entry 6 months), January 2010 – April 2010 (entry 6 months), May 2010 – August 2010 (entry 6 months), the end of September 2010 – December 2010(entry 6 months) , the end of January 2011 – April 2011(entry 6 months) and 6 June 2011-28 june 2011(just a month)
Last June 2011 when I landed I went back for an interview and a Mexican customs officer told me that I put a lot of questions probleme.mi over questions such as for 3 hours doing here, what do , where we have money to travel so often, why come to the U.S. so often. I said I have an agency organizing the event and many things to buy in the U.S. and sell them in romania, I have a boyfriend in the U.S. and he helps me with the shopping. he found Bank of America card and accused me of working in the U.S.. I explained that he can see with no pre collect money from anyone and that I use for shopping in the U.S. because of romania not go on certain sites. He controlled handbag and I vezut many other personal bags and shoes. He spoke very bad with me and accused me of things zipat untrue and that where I have money to buy so many bags and travel. Anyway point is that he told me he let me go in the U.S. only a month, but I quote him now: I do not like you and do not want to see you in my country for a year. the passport I did not put nothing but stamp with entry a month. I was back in romania on June 28 the limit is 5 July. He can say something verbally or pass a ban on the passport? It is normal to speak to me so awful
I can do something to see if i ban or not because nothing appears on my passport that I wrote as I am not allowed to come to the U.S. a year?

    thank you very much

  • gabriela

    i forgot to tell that i have visa type R , class b1/b2 , entries M
    thank you

  • Simon80014

i got deported 4 months ago from denver to germany. the process was horrible and inhumane, my little brother was also deported and we are both stuck here in germany. alot of people say this is a great place but it really isnt. i am looking to move to canada to start a new life and to be closer to my kids so my question is. will canada do an american background check on me or will they only do a german background check, my history here is clean and there should be no problems on that end. but im wondering if they are gonna ask questions cause my english is perfect and ive lived in america preety much my entire life. any info would be great. thanx all.

  • Michelle R

I really need help or a good lawyer. I am a US citizen who married an illegal immigrant. He overstayed because being 8 years old you have no idea what your doing anyways. He served his time at Rikers Island (less than a year) but has an immigration hold on him. His release date was today 12/09/2011 and I have filed to remove the immigration hold (case is still pending) but i’m not sure what the next step is. I don’t want to waste money and get nowhere. I know ICE may detain him over the next couple months. What can I do on my end?

  • babygirl1982

I am in the same situation. I currently had to hire a lawyer for my husband’s case. He was caught crossing the border, and was given a 20 day sentence. He is lucky because I have heard of worse sentences. Anyways, the lawyer has been working around the clock to plea his case, putting in paperwork before ICE place a hold. My suggestion would be for you to get an immigration lawyer ASAP. You can’t remove an immigration hold. Once it’s there, it will still be there until ICE picks your husband up and move him. Get a lawyer now, that is the best way that he has a chance. Otherwise, if not, he will not have a chance. Hope that helps and good luck to you. Keep us updated, for I am inn the same situation as you are.

I don’t know any details on Canada but I would sort it out soon before our silly country ‘integrates’ with the Excited States of America with the new ‘north america perimeter’ – one of the worst pieces of shit our country has done in a while

If you get to Canada we welcome you. Just not sure about ‘them’

I realy need help,my son German citizen got put in Prison, for 42 years, now i find out about international Law,that he had the oppertunity by the time of courtsentence, that he could be deportet back to Germany to do his defently less time for the crime he did here, nobody at the courtsystem,or homeland informed us about this.He is alreadey 7 years in Prison, there is also a immigration hold on him,he come legal to the U.S.A. with a valid greencard. My qwestion and help i need, how to i find out more,to maby get him deportet back to germany true the international Law Procedure.Any Help i appreciate.

  • sweetgirl:)

i lived legally for 8 years and over stayed for  6 short months..boom..six ice guys kick my door in, for NO reason..lied and mislead me,my family, they detained me for 3 months and deported me to england..21 years young,5’5,105,and easy on the eyes ;) we need to STAND UP.Not let these bastards get away with the inhumane treatment of us! they dont GIVE a FUCK..lets show em whos bosssss and no longer keep quiet =]

  • Simon80014

the way its looking he has to do his time no matter what and then once he is granted parole they will parole him to the detention center that does immigration holds. in denver where i was they have theyre own holding center and thats where he will be able to see a judge to fight his deportation if he wants. which i would strongly advise against seeing that he has a sntence of 48 years. if he doesnt fight the deportation he will most likely be deported within 3 months. i was flown directly in to frankfurt and handed over to the federal police of germany, asked some questions, stripped searched and that was it i was on my way. the only way i think he can get out of doing his time is go back to court and try to get reconsideration and if they give him that then he must agree to himself being deported. that might be the only way. good luck to you and him and let me know if you have any more questions.

  • Simon80014

screw ice those bastards came to my house and my work looking for me and finally i turned myself in cause i wasnt feeling like running anymore. those people ruined my life and if i ever see one of those peices of shit on german soil they can count on having a bullet put in them. i miss my kids and my life and it sucks that those bastards can just take everything.

  • Lady

thank you so much for responding,it was very helpful to me and my son.How long was you in,befor there deported you?Was you able to come back here after all.My Sons Parole will be in 2024.So hope something good come befor that

  • Simon80014

i was picked up at work one day out of nowhere and i had no clue that i was even wanted and then ice came and took me to a immigration detention and i sighned a paper saying i wanted to see a judge within 10 days. after i saw a judge and spoke to a few people i figured out that waiting it out and trying to fight it was a lost cause givin that i had an aggrivated felony for auto theft when i was 18. im 31 now and i really did not want to fight the government cause like almost everyone knows its a losing battle. so after i got deported by the judge and signed my papers the next step was to wait on a travel document from the german embassy. that took almost 3 months and then they came and took me to the airport, flew me to frankfurt international and that was it. from there on i have been a free man with no german record so its basically like starting life all over. ive been here now for about 4 months and im not ever allowed back to america so my next step is to save up enough money so that i can move to canada to be closer to my kids. my advice for your son is to try to get his sentence overturned so that he can be deported sooner. if he fights it he can be held for a long time in the immigration place so i wouldnt suggest that. plus germany isnt so bad, no matter what when he gets here he gets a free apartment and money every month just for being a german. good luck to you and him let me know if you have any more questions.

  • sweetgirl:)

Hey! They will take them to their home country, only under extreme circumstances(commiting crimes in your home country and their govt doesnt want u back, are u allowed to go else where, which is still rare!) Depending on the way one entered the US..They are allowed to see a immigration judge and get a bond to be released..Deportation to MX takes a matter of days, when being held in places like FLORENCE and ELOY.( I know as i stayed at Eloy detention center for 2 months) Good luck! if u have any questions let me know.

  • sweetgirl:)

Im so sorry simon! Crazy stories..My sister and I were both deported too , like you and your brother! Twins..Lol.. Let me know if u get answers as im planning on moving to canada or mexico to be closer to my hubby.. Im so sorry this happened to you Simon. good luck! & never give up. I have a pending drug charge, and i am still NEVER giving up…America will be my home once again, removed or not:)

  • Simon80014

well seeing that i have an aggrivated felony if i cross the border im facing 20 years and that doesnt sound to fun to me right now lol. either way though ive been looking into some of canada immigration and they are saying that they wont let anyone in with a felony on theyre record. what im trying to find out though is are they gonna do an american background check or will it be a german background check. ive lived my entire life in america so if they just run my german background then i am clean as a whistle on that aspect. showing up i will have all my german documents and i can speak pretty good german so who knows right. well sorry that you and your sister got deported also i bet your family is just as crushed as mine, sucks that the world has come to this ya know. well good luck to you and her and if you have any questions you can find me on here or on my facebook. christian simon. and i live in pirmasens. should be able to find me that way. take care and talk to ya soon.

I have a question for COMMIE B, as you seem to be the voice of experience on this blog…I have a 15 yr old granddaughter who is half Jamaican. Approximately 12 yrs ago, while living in Pennsylvania after separating from with my daughter and granddaughter, my son in law was arrested on a drug charge and deported. (He claims he was just at the wrong place at the wrong time, I’m not sure). Anyway, he was transferred to a detention site in Maryland where he was held for close to a year and then deported back to Jamaica. He was told he could not return to the US for 10 years.  He has been out of the US for 12 years!  I try to take my granddaughter to Jamaica once every year so she can see her father. Her father recently tried to obtain a visa to come back to the US due to some molestation issues and he was denied on the grounds that his prior charge and reason for his deportation in the first place was drug related. Not having her father her has proved to be a true hardship for my granddaughter. He also has another child here in the US with another woman (from after he and my daughter split up). What my granddaughter wants to know is if she can petition the Jamaican government for her father to be able to return to the US since it has been 12 years since he has been deported. He has not gotten into any other trouble back in Jamaica. Has led a clean life. Any idea if she can petition for him? Please reply to smhardinger@yahoo.com.  Thanks in advance Commie B for any assistance or advice you may provide.

  • Me

The simple thing is – you commited the crime – you get deported. No matter what color you are.

  • Me

Remember – criminals go to prison. Judge will never say – “oh, you killed the guy, but I see you have a mother. You can go home now”. This is not how it works. The rule is simple – crime->prison->deportation.

  • Me

Crowled through one of those holes across Mexico border. Too bad he was not shot for that crime.

  • WHY

I hate when peopl;e just judge and dont know the whole fuckin story well my sons father made a mistake, yet he was in the navy for 4 years but that doesnt matter he can risk his life for this bullshit racist ass country and still get deported when all the bullshit ass politicans can rob and steal and get house arrest. OH AND YES IT DOES MATTER WHAT COLOR YOU ARE!!!!!!!!! And before you waste your dumb ass breath I am an american citizen!

  • Mrs.Soto1991

someone please help!!! my husband and i  were driving from florida to chicago 3 months ago but ended up getting pulled over in Adel, Georgia. We were both detained on September 18,2011 for questioning. I was driving a car that was used in a “crime” in Florida which is complete crap but w.e. Point is because of that our 15month old son was taken away by DCFS and I was 8 months pregnant also. Well I got released on my bday which was the next day September 19,2011. My husband unfortunately was not that lucky they ended up leaving him there which fukin pissed me off. When I get out of the jail to the police station to pick up my belongings that bastard who did all this crap started saying that he was going to charge my husband with possession of cocaine. He then showed me the amount of cocaine that he had “found”  in MY CAR. It wasn’t even an ounce it looked more like residue. The detective said that he had found it in the car in a BROWN WALLET!!! For that bastards info my husband owns two black wallets never in his life has a owned nor looked at a brown one. When I start asking questions about the drug and start explaining that there has to be a mistake because the drug is not his the detective then says and I quote, “Oh would you like me to charge you with it then since it was in YOUR car!” I simply got my shut and left quick as hell, I was in Georgia and had no family members theres, my son was with DCFS, my husband still incarcerated, and had no where to go. The next I went to court and got my son back since I had no pending charges. The freakin detective charged my husband with 9 grams of cocaine. How the hell does 9 grams of coke fit in a guys wallet? and how come that bastard of a detective kan get away with that? My husband has asked to see the evidence since in court they offered to show it to him and still nothing. We are now in December and they don’t want to show him any evidence so I am going to go to his court date which is sometime in January or february and I am going to be his witness. Nobody wants to help, everyone is just focusing on the fact that he’s an immigrant. Please someone help me he’s chilean and has been in America since he was 2 years old. We are both married and i’m an american citizen born here. I gave birth November 25,2011 to our second son. Why don’t people just leave immigrants alone? at least the hard working ones. He did his taxes, went to school, got paid with checks, and doesn’t have a record. This is his first offense, please I am desperate we are in love. I am 20years old and he is 19. yes i’m older by a year:) well if no1 has any answers then i am willing to move to chile with him and our 2 kids. I don’t know why I am going through this I was even homeless when I came to Chicago I just found a place to stay at a month ago. Please I am begging for answers or if anyone knows of a really good immigration lawyer please reply bak. My email is Reyes.danet@yahoo:twitter .com

Go to your Embassy. That’s better than going to ICE as they’re more likely to make matters complicated. Remember, they have a quota to meet – do you really want to give them a freebie for no reason at all?

You can apply for a new passport at your embassy in the US – you don’t have to go anywhere. But let the passport expire for too long and you could eventually be looking at problems.

My husband came here as a child, got a misdemeanor when he was 18 so had a deportation order but didnt leave. Then we meet, had
a baby and I was pregnant again when he got picked up again and deported. he gave back but got caught abd deported yet again
so now has a 15 year bar until he is able to come back. He is back now, has been for almost 2 years but still here illegally, we are
now married and have 2 kids. I spoke with a lawyer when he was in immagration and the lawyer said he can try to get the
misdemeanor charges dropped and then work on the deportation orders but this was before he got caught the last time. Do you
have any advice for us or suggestions. Thank you in advance.

Yes but it will be a slim chance.

  • http://www.asifism.com Commie B

You can’t as far as US immigration is concerned.

  • http://www.asifism.com Commie B

Apply for permission to enter first.

  • http://www.asifism.com Commie B

Couldn’t tell you, sorry. Only the local embassy / consulate can tell her that as each country has different procedures.

If you have a drug charge, you can be assured that you will  be denied.

  • Domestic violence problems

    Hi,

My wife and I have been married for 3 years. We have a 2 year old and a 6 month old baby. My wife and I have argued (verbally) a lot since we got married. Lately, she had gotten worse and started breaking things, and one day she locked me out of my office (I work from home), took my Internet connection, and sat down on the floor. I went up to her and bumped her on the buttocks three times with my foot while I said “get up and open the door”. At the same time, our boy was walking around hitting things with his toy drumstick, which I took away from him. As she did not get ut, I also intended to tap her (not hard) on the buttocks. But as she got up simultaneously with me tapping her the tap became harder than intended. She went and called the cops. They arrived within minutes, and arrested me under California Penal Code 273.5(a) and charged it as a misdemenor. I went to jail. My wife came to better senses after a while and I was lucky to get bailed out ($2700 lost). I pled “not guilty” at the arreinment, and hired a lawyer that said he’d do everything up to the jury trail for $3500. My pretrail is on tuesday. I have given the lawyer lots of documentation from my wife and I to try to sway the Deputy District Attorney to reduce my charge. If I am found guilty of the charge, I believe I will get deported, according to what I have read. I have been thinking about all this a lot.. And I have come to the conclusion that I do not mind leaving the U.S. Americans think they live in the best country in the world and that no other country have got what they have got. Having lived here for 6 years (in California), I do not agree with that view. USA has a lot of poverty and harsh conditions, a lot of crime, also a scary legal system that e.g. almost convicted Michael Jackson to a life in state prison even though he had not done anything wrong (the D.A. suppena’ed perjury’ed/liars). Get the video of Michael Jackson and have a look at him walking into his last jury trail. That day he could be found guilty, and taken away for the rest of his life to state prison! In the video of Michael walking into the jury trial he looks like a dead man walking.

I think it is fundamentally and ideologically utterly wrong of USA to handle all its problems in the legal system. Young people with problems are being turned into criminals..

I think it is very wrong of USA to break up families and deport people because they have some dirt on their wings.

I think many of these things, and combinations of them, are what is causing the current financial crisis of USA.

I am going to move back to my home country. We might visit USA in periods, for my wifes sake, but I honestly do not wish to stay in this country anymore. I do not say this in anger or bitterness. I know my home country has its problems too, but the quality of life will be better there for myself and my family. God has made the world. He has not made any place on the earth better or worse than any other place, just different. I think there is opportunity and hope in every place on earth, we just have to find it. USA seems like a easy solution, but there are other “problems” here that are rare other places. Consider that as well. What is USA really worth? Answer: Not as much as Americans think! Regardless, life on earth is short. I seriously do not believe that criminal records carry into heaven. I think God will look positively at one having anguished in jail for years. I wish to seek to goodness of the remainder of my life for my family and myself. I think that can be found in my home country too, I just have to look for it/seek it and find it with Gods help.

We might move back to USA, but if so I will live very fearful, knowing that leaving a red mark on your wifes buttocks might be considered a felony in the US and punishable by up to 4 years in prison. If my kids get mad at me and accuse me of someting, I could be toast. If someone see me spank my kids in public, and someone calls the cops, I could also be charged with up to a felony/4yrs.

    Some advice:
    - Be careful with saying “no contest” or “guilty” at the arreinment. I think many think that this sign of “humility” will make the judge sympathetic to you. In reality he’ll just sentence you as charged. I heard that pleading “not guilty” can help. You’ll need a lawyer, but a public defendant will be given you if you make very little money. I was denied a public defendant because I make too much.
    - Do not hit your spouse or kids in the USA! Its safer to walk through a hard gang infested neighbourhood wearing nothing but red clothes! When the person annoys you to the brink of your sanity, just smile and go for a walk. It’s cheaper that she teares down the house than to go through the legal system.
    - Be careful when you talk to cops. When they are listening to you, they are just probing for a “probable cause” to arrest you. Thats what happened to me.
    - Sign up for a government approved Domestic Violence course. That will look very good to the D.A. Actually, both of you signing up, looks even better.

I wish the best for all of you and hope that everything works out good.

    All the best,
    O

Hi, i’m an irish citizen that was deported from Boston in 06 for ten years. i was involved in a minor traffic accident while drunk. I was also caught earlier with a small amount of weed (dime bag) for personell use which was scrapped and thrown out of court due to a source. I am wondering what my chances of re-entry after my ban is up ?

  • mollie

My husband and I have been together for 17 years and have 5 beautiful children and recently my husband had words with a CPS worker who was falsly accusing him of something he did not do well little did we know she is a booty call for an Ice agent. Now my husband is being deported back to Canada after living the states for the past 46 years, he moved here when he was 4 years old. Do you think the government gives a crap about the welfare of me and my 5 children who are all american citizen, hell no! It really is about who you know and who you are willing to sleep with!

  • ANGRY VICTIM

What the hell is wrong with you? you are sitting here bashing the United States saying we dont give a shit about abiding by the laws which are in place. When if you are here illegally you have broken many of those laws to be here. And then you expect our laws to be followed with it comes to you?  REALLY? What gives you the right to expect anything, when you have come here with no respect for our country or what it stands for?   ALL YOU WANT IS TO BE GIVEN EVERYTHING WITH NO REGARD TO OUR COUNTRY. Who’s side would you fight on if we went to war against your country? Hell your own people use and abuse its citizens, putting peoples lives in danger by smuggling them into this country. They are lied to,taken advantage of, robbed and most time left to die and abandoned. How DARE YOU!  My son was murdered in his own home by two illegals with violent criminal pasts involving attempted murder charges, and I watched them for 9 years get more rights afforded them than myself or my son who was an innocent victim shot in the back as he was complying with their orders. Our government has forgotten its loyalty to the people of this country in its quest to equal rights. Go back to your own country and demand it take care of you, instead of coming here. Or else become a citizen the legal way then you have a right to a say. YOU JERK

  • mollie

I myself am an american, born and raised and not one bit proud of the way we treat people, including our own citizens. Free country…not even close. Land of opportunity…where? This is why my flag no longer is flown!

  • Fucked with the wrong bull

Fuck ICE!! They sent my tax paying, law abiding wife back to Romania after 5 months of her being in detention. She lived here for 10 years worked doing RealEstate, just doing great, and was very happy. Then our lives where turned upside down all because someone went, and told their friend ICE officer some false things about us,and our marriage.I’m a born U.S. citizen. Now she is back in Romania, and USCIS is giving us a difficult time about her coming back.I swear,I’m so fucking pissed off!!! They are the scum of the earth!! They are just as corrupt, and fraudulent as any common criminal. They all need to pay for the criminal shit they do.This makes me fucking hate my fucking piece of shit government, and country for that matter. It’s been over run by Scum like The Dept.of Homeland Security.9/11 was an inside job done as a pretext to cause this kind of shit. It’s only gonna get worse. Now with the new NDAA bill that was just passed.I won’t stand for that shit.If they bring it to my door the way that ICE came knocking to take my wife away, there will be blood on my door step, and it won’t be my blood!!

  • cobra5000

I’m a U.S. Citizen and my wife is Brazillian.  Ice gave her a deportation date and she has to show up with tickets and a new passport.  Getting deported and having to pay for your own tickets is bad but forcing her to leave her 3 year old child is discusting.  I thought they would only do this to people who commit crimes.

  • cobra5000

I love America but we didn’t settle this place.  It was already settled by Indians.  When was the last time you saw an Indian now?  Everyone’s family came by boat or plane.  Me and my 3 year old are U.S. citizens and someone who comes and learns the language should be allowed to stay.  They come here and don’t have our benefits and live a hard life but its safer than where they came from and the Republicans shoot down any kind of Immigration reform that would give people a path to Citizenship.  Now when you get deported you now will never be approved for a visa and be banned from entering the US for at least 10 years even if your married and have children.  Now I have to take my son to Brazil 4 times a year but cant move there because i have to take care of my elderly Mother.

  • Claudia

I am trying to find out how I can help the father of my eight year old daughter. He was caught by Canadian ICE a few weeks ago. He is now awaiting deportation. I live in the United States which is where he was when we concieved our daughter.  I have never delt with anything like this but i want to do something but not sure where to start. Anyone have any input on what i should be doing.

Not everyone are like the violent criminals. Have you ever thought these illegals with violent criminal past was due to the fact that they were never given an opportunity like you and your son had. Resulting to criminal activities because.. what else can they do here? College? Uh well when your family can only work at McDonalds can you afford the college costs, when they grew up in a country where their family had to work full time, mother and father gone from the home, trying to provide for there family. Maybe there paths would have been different. Sorry for your son. However, there are multiple scenarios where a person who has lived in America more in his life than he other country, with an entire family in America, has kids of their own. Then gets deported to some place that’s not familiar. Left kids and a wife behind. When did America lose its sympathy, and why should we not question the ICE, with the governments view towards illegals a disease has spread over this country, the belief Illegals are basically scum of the earth, and we have massive hate towards people of are own kind. Whats makes us all American? Obviously not a race, were the melting pot, have people nowadays forgotten that. Is an American just someone who holds a passport or was born here? Those reason seem quite non-sensical, if thats what you can consider an American, what exactly have YOU done to deserve everything you have given to you by America. Why do YOU deserve your freedoms? Because you were born here? Or because you are a resident of America and have grown up here, you breath Ahmurican, you know no other place… O wait, aren’t you exactly what the ICE have been sending away. So you know what, as an American who is grateful for the U.S. I have my freedoms to say whatever I want, to question programs… like the ICE, because someone doesn’t have a passport we have the right to treat them like crap. There PEOPLE like YOU. Gasp I compared you to an illegal!
Continuing, you also say that people should wait, well as a u.s. citizen you may attest to how awesome it is to have you’re opportunities. There are people not as fortunate to be born into an Ahmurican family, they live in a country where the economy is bad, worse than the U.S, a place where their country is not stable, secure for a family.. So They should wait Twenty years to bring their family here…o wait, there family will still have grown up without any opportunities like the privileged ahmurican life you lived. So YOU wait 20 years. Hard life. Y u no sympathy? Who really are the savages?

I was living in USA up until resently and got deported back to England after a month in ICE custody, when i was on my way to Tennesse from California. I had been in California for 6yrs, 5yrs of that time i wasspending it trying to find a way to escape from my ex boyfriend that i refused to marry because of all the verbal and physical abuse i was having from him, i was unable to work and he made sure i never had any money etc thats why it took me so long to get away from him. I eventually had his brother and one of his friends help me get away. But at the boarder in Texas ICS took me of the bus and locked me up being illegal, i was sent to 5 different deportation centres before they flew me back to UK via private plane which dumped me at Luton Airport with no money and no way of contacting anyone. While i was awaiting deportation i let the authorities know what i had been going through ( his abuse, His drug dealing and all the porn not just the normal porn for men either) and where i was going but they never gave a damn. I got a ten yr ban from USA. I have no family here in England, all i have is my fiance Allan his mom and my 12yr old step daughter in Tennesse.
Can anyone tell me seriously how we can get this ban over ridden so Allan and i can marry in Tennesse, our wedding plans are already sorted and the house is build for us on the families 100′s of acres of land, i just need to get there. They own so much land the freeway goes through there land, They even tried putting the land up as bond for me but ICE refused it, even though Allan was a ICE Agent years ago and his cousin still is in a different state. Allan left because he hated the way people of all nations we treated.
So WE would really appreciate antone that could help us find away for me to get back there without having to wait 10yrs.
